Qwest Performance Assurance Plan Update
Penny Baker is an assistant general counsel for the Iowa Utilities Board (IUB). She has also worked for the Missouri Public Service Commission as deputy general counsel and has experience with a private law firm, specializing in tax and estate planning.
Ms. Baker is a member of the state staff on the Joint Conference on Accounting, the staff of the Qwest Regional Oversight Committee, and a member of the Qwest 272 Audit Joint Oversight Team. She has represented the Missouri Commission in numerous Federal Energy Regulatory Commission and Federal Communications Commission proceedings and appeared on behalf of both states on appeals of agency actions. While at the IUB, Ms. Baker worked on the Qwest 271 application and its implementation, after working on Southwestern Bell’s 271 application in Missouri.
Ms. Baker received a bachelor’s in accounting from Northeast Missouri State University (now Truman State University) and her law degree from the University of Missouri-Columbia. She holds a CPA certificate and is a member of the Iowa and Missouri Bars.

Charles King is an executive consultant with the Liberty Consulting Group with 26 years of experience in the telecommunications industry. While at Liberty, Dr. King has managed several audits of ILEC performance metrics and performance assessment plans throughout the country. He has also provided analytical support for arbitrations and acted as an advisor to commission staffs in analyzing the impact of the Triennial Review Order. Before joining Liberty, Dr. King was a managing director at BearingPoint and worked for a number of years for AT&T. While at BearingPoint, he was a member of the team performing third-party testing of RBOC operations support systems used as part of the Section 271 compliance assessments in many states, including the test performed for 13 of the ROC states. In addition to his consulting work, Dr. King has held management positions in product management, government affairs, regulatory finance, industry standards, telecommunications demand forecasting and pricing, strategic planning, mergers and acquisitions, and research and development. He is a summa cum laude graduate from Northwestern University and holds a doctorate in physics from Yale University.

Wendy M. Moser is a vice president of policy for Qwest Communications International Inc.
Ms. Moser is responsible for public policy corporate staff, developing and implementing company strategy, and advocacy for regulatory filings before the Federal Communications Commission and state public utilities commissions. Her team provides regulatory, contracting and tariff support to the Qwest business units in the marketing and provisioning of products and services to retail and wholesale customers.
Ms. Moser has worked for Qwest and its predecessor, U S WEST, since 1993. Before that, she was a trial attorney with the Denver-based law firm of Sherman & Howard. Federal Communications Commission Update
Commissioner Anne C. Boyle was elected to the Nebraska Public Service Commission in November 1996. She was re-elected in 2002, and served as chair from 2002 to 2004. Commissioner Boyle is a member and past president of the Mid-America Regulatory Commissioners; on the board of directors for the National Association of Regulatory Utility Commissioners (NARUC); a member of NARUC’s Consumer Affairs and Telecommunications Committees; and serves on the North American Numbering Council. She serves on the Nebraska Broadband Task Force and is a past member of the Omaha City Charter Review Committee. Commissioner Boyle is president of the Omaha Summer Arts Festival and has been president of the Blue Barn Theatre and co-chair of the 2000 Nebraska Aids Project, Night of a Thousand Stars. Gene Fullano is assistant bureau chief in the Enforcement Bureau of the Federal Communications Commission. Among his responsibilities are enforcement matters related to the wireless industry.
Mr. Fullano has also served as legal advisor to the chief of the Consumer & Governmental Affairs Bureau and as an attorney advisor to the Accounting Policy Division within the Common Carrier Bureau. He has been federal staff liaison for the Federal-State Joint Board on Universal Service.
Mr. Fullano has also been a private practice attorney specializing in telecommunications and energy regulatory matters.

Marcus Maher is legal counsel to the Chief of the Wireline Competition Bureau of the Federal Communications Commission. He served as team leader for the FCC’s SBC/AT&T merger proceeding, and worked on a variety of competition policy matters, particularly those dealing with unbundling and broadband issues. Prior to joining the FCC in 2003, Mr. Maher was an associate at the Washington, D.C. law firm of Wiley Rein & Fielding. Intercarrier Compensation
Philip Jones was appointed to the Washington Utilities and Transportation Commission in March 2005. He is the founder and president of Jones & Company, an international trade and government affairs consultancy based in Seattle that assists companies that are expanding business activities in foreign markets, and helps energy firms develop new commercial markets in energy production and distribution. Before coming to the commission, he served as managing director of Cutter & Buck (Europe), BV in Amsterdam, Netherlands for five years. Commissioner Jones has held positions as a trade policy and energy consultant; senior legislative assistant to Sen. Daniel J. Evans; director of the state of Ohio’s office in Tokyo, Japan; and director of the program on U.S.-Japan relations at Harvard University.
He serves on the board of the World Affairs Council and is a member of the Pacific Council on International Policy, a think tank based in Los Angeles that promotes discussion on international affairs and trade issues.

Ray Baum was appointed to the Oregon Public Utility Commission (OPUC) in August 2003. A country lawyer for 20 years, he spent eight years in the Oregon Legislature. There he served as chair of the Joint Committee on Trade and Economic Development, chair of the House Natural Resources Committee and was the House majority leader. Before his appointment to the OPUC, he served five years on the Oregon Liquor Control Commission.
His responsibilities at the OPUC include telecommunications. Commissioner Baum serves on the National Association of Regulatory Utility Commissioners (NARUC) Telecommunications Committee, the NARUC Task Force on Telecommunications Act Rewrite, and the Federal-State Joint Board on Universal Service. He is chair of the NARUC Task Force on Intercarrier Compensation.

Glenn Brown is President of McLean & Brown, a telecommunications consulting firm specializing in universal service and access reform issues. Prior to joining McLean & Brown in 1998, Mr. Brown worked 28 years for U S WEST where he was responsible for leading the company’s advocacy efforts in the federal and state arenas. He has presented testimony on a wide range of telecommunications regulation and pricing issues before numerous state regulatory commissions, the Federal Communications Commission and the U.S. Congress. He is a nationally recognized expert in the areas of universal service, access reform and rural telephony issues.

John Kure is an executive director in Qwest’s public policy organization concentrating on access and local interconnection issues. Joel Lubin is vice president of regulatory planning and policy at AT&T. He is responsible for developing public policy at federal and state levels. In particular, he formulates regulatory policies associated with access charges, universal service, local exchange competition and LEC regulation and has managed, directed and led large interdepartmental teams addressing these complex issues
Mr. Lubin has testified before the Federal Communications Commission, Federal-State Joint Boards, and congressional committees addressing access and universal service issues. He was appointed by the Federal-State Joint Board to participate in a multi-year rural task force to address universal service issues associated with rural telephone companies. Mr. Lubin is serving a second term on the Universal Service Administration Company Board and is the vice chairman of this board.

Ron Williams is vice president of interconnection and compliance for Alltel Communications. He is responsible for overseeing intercarrier relations, including interconnection and reciprocal compensation matters, as well as E911 compliance, for Alltel’s wireless operations covering 33 states. His time is split between the pragmatic issues of leading a team dealing with day-to-day carrier relations while developing more strategic and sustainable long-term solutions for Alltel’s interconnection needs. Having nearly 20 years of telecommunications experience with both wireline and wireless carriers, Mr. Williams has been an advocate for efficient market-based solutions to issues facing the industry.
In addition to his time with Alltel and Western Wireless, Mr. Williams’ telecom experience includes senior management positions with GTE, as well as general management responsibilities in CLEC operations. He has led start-up companies in the diverse fields of computer graphics and international distribution and multiple teams involved in market deployments, sales and operations.

Confronting the New Realities of a Changing Telecommunications Landscape
Since arriving at the Colorado University School of Law in 1999, Professor Philip J. Weiser has worked to fortify CU’s strength in telecommunications and technology law, establishing the Journal on Telecommunications & High Technology Law and the Silicon Flatirons Telecommunications Program. He writes and teaches in the areas of telecommunications and information policy, recently co-authoring the book “Digital Crossroads: American Telecommunications Policy in the Internet Age” (MIT Press 2005). Prior to joining the CU faculty, Professor Weiser served as senior counsel to the assistant attorney general in charge of the Antitrust Division at the U.S. Department of Justice, primarily advising him on telecommunications matters. Before his appointment at the Justice Department, he served as a law clerk to Justices Byron R. White and Ruth Bader Ginsburg at the U.S. Supreme Court and to Judge David Ebel at the 10th U.S. Circuit Court of Appeals.

Net Neutrality
Ted Boyer was appointed to his first term on the Utah Public Service Commission in June 2003. He is a member of the National Association of Regulatory Utility Commissioners (NARUC) and serves on NARUC’s Telecommunications and International Committees. Commissioner Boyer is vice president of the Western Conference of Public Service Commissioners.
Prior to his appointment, Commissioner Boyer served on the cabinet of Gov. Michael Leavitt as executive director of the Utah Department of Commerce and before that as director of the Utah Real Estate Division. He practiced law in Salt Lake City for more than 20 years.

Steve Davis heads Qwest’s public policy organization and is responsible for the development and advocacy of the company’s policies in regulatory, legislative and other governmental forums.
Mr. Davis joined Qwest in January 2000, as senior vice president and assistant general counsel of policy and law. He has more than 22 years experience in telecommunications law, with particular emphasis in local, state and federal regulatory law. Prior to joining Qwest, Mr. Davis held various legal and regulatory positions with AT&T where, from 1996 to 2000, he was responsible for representing AT&T’s interests in all state and local governmental matters. Prior to that, he held positions as chief counsel for AT&T’s consumer services division, chief counsel for AT&T’s Universal Card Services division, and head of AT&T’s federal regulatory and antitrust group.

Kyle Dixon is senior fellow and director of the Federal Institute for Regulatory Law & Economics for The Progress & Freedom Foundation. Mr. Dixon joined the foundation in 2004 after serving in various capacities at the Federal Communications Commission for more than seven years, most recently as deputy bureau chief in the FCC's Media Bureau and special counsel to the chairman for broadband policy. He worked as an attorney in private practice with Hogan & Hartson LLP and as a clerk for the Honorable Richard D. Cudahy of the U.S. Court of Appeals for the 7th Circuit. He has taught a course in communications law and policy at the Georgetown University Law Center.

Bill Heaston is the general counsel for PrairieWave Communications Inc. His practice of law involves corporate governance, state and federal regulation, and lobbying industry issues before state and federal legislative and administrative bodies.
Mr. Heaston was the general counsel for Dakota Telecommunications Group (DTG) from 1998 until its acquisition by McLeodUSA in 1999. He was a deputy general counsel for McLeodUSA, providing legal advice on wholesale, carrier and major customer contractual matters, state regulatory issues, and the business-to-business relationship with Qwest. In 2002, PrairieWave Communications acquired the former DTG operation from McLeodUSA, and he remained with the operation.
From 1986 to 1998, Mr. Heaston was a senior attorney for U S WEST, providing legal support and advice for its operations principally in North Dakota, South Dakota and Wyoming. He retired from the U.S. Army in 1986 after 21 years of service with the Judge Advocate General’s Corps.

Video Franchising
Commissioner Bob Sahr, chairman of the South Dakota Public Utilities Commission, is a national leader in protecting consumers and developing telecommunications infrastructure in rural America.
He led the effort to create the South Dakota Do-Not-Call List. As a result, more than 312,000 South Dakota landline and cell phones are on the list.
Since 2002, Chairman Sahr has spearheaded a first-of-its-kind-in-the-nation program to build more cell phone towers. This has led to unprecedented investment in new cell tower sites in South Dakota with service coming to many rural communities for the first time.
He is the chairman of the Qwest Regional Oversight Committee and secretary of the Mid-America Regulatory Conference. He began terms for both offices in 2005. He also serves on the Telecommunications Committee of the National Association of Regulatory Utility Commissioners.
Chairman Sahr graduated with honors from the University of Colorado, Boulder and worked in sales and marketing for Michelin Tire Corporation. He earned his law degree from the University of Colorado School of Law.

Susan Bitter Smith has been executive director of the Arizona Cable Telecommunications Association since 1980. She is a past chairman of several organizations including the Walter Cronkite Foundation, Arizona First Amendment Coalition, Arizona Competitive Telecommunications Association, Arizona Society of Association Executives, American Society of Association Executives (ASAE), and the ASAE Government Affairs Committee. She is a member of the ASAE Government Relations Section Council and is an ASAE Fellow.
A native of Arizona, she has served on the Scottsdale City Council and was vice mayor. She is currently an elected member of the Central Arizona Water Conservation District Board of Directors.
In addition, she was co-chair of Arizonians for Bush/Quayle in 1988 and 1992 and chair of the Forbes in Arizona Campaign in 1996. Ms. Smith was a founder of Arizona Women in Cable and the Valley of the Sun Cable Club.

Commissioner Curt Stamp was appointed to the Iowa Utilities Board in September 2005 by Gov. Tom Vilsack to fill an unexpired term through April 2007.
Commissioner Stamp is a member of both the Telecommunications and Intercarrier Compensation Task Force Committees of the National Association of Regulatory Utility Commissioners. He also serves on the Federal-State Joint Board on Separations and the North American Numbering Council.
He has years of public policy and utility experience. Most recently, Commissioner Stamp was an attorney in private practice working with various telecommunications and utility clients at two Des Moines law firms. He served as a legal intern in the office of Federal Communications Commissioner Kathleen Abernathy. Steve Furtney was first appointed to the Wyoming Public Service Commission in October 1997 and reappointed in March 2001. He was elected chairman of the Wyoming Commission in July 2005. His current term expires March 1, 2007. Chairman Furtney is also the president of the Western Conference of Public Service Commissioners and is a member of the National Association of Regulatory Utility Commissioners’ Telecommunications Committee.
Chairman Furtney served as division administrator for the Wyoming Department of Administration and Information, Economic Analysis Division from 1991 to1997. During that time, he co-chaired the Wyoming Consensus Revenue Estimating Group. His previous experience includes 12 years as a research economist for the economic analysis division.

Mike Dalton has been involved with the Canopy product line at Motorola since its launch in June 2002 and has more than 18 years of field sales experience in the RF/Microwave systems markets. For the last 10 years, Mr. Dalton has specialized in the sales and support of such systems in the unlicensed frequency bands, with a specific focus in spread spectrum and UNII frequency band products. His experience pertains to voice, data, and video applications using both point-to-point and point-multipoint systems. Additionally, Mr. Dalton has worked in both direct sales and channel sales models and is very familiar with the many ancillary products and services available to enhance these systems and their IP service offerings.
